What We Do

Court of Protection Help offers guidance and support through each stage of the Court of Protection process. Here’s how we can assist you:

  • Deputyship Application: We help you apply to become a deputy, giving you legal authority to manage the financial affairs and property decisions of someone who lacks mental capacity. This includes handling their bills, property, and financial responsibilities.
  • Permission to Buy or Sell Property: If the person lacks capacity to make decisions about buying or selling property, we assist in securing the necessary permission from the Court of Protection, ensuring all transactions are managed in their best interests.
  • Emergency Orders: In urgent situations, we can help you apply for an emergency court order to protect the person’s assets or make crucial welfare decisions.
  • Accommodation Orders: We assist with applications to secure accommodation or make living arrangements that best support the person’s wellbeing, especially if they need to move into more suitable housing or care settings.
  • General Permission Orders: If specific decisions need to be made that fall outside a deputy’s existing powers, we support you in applying for general permission from the court to ensure the person’s needs are met.

Steps in Your Application Process & Pricing:

1. Pay nothing to get started — no upfront fees until your onboarding call.

2. Complete our questionnaire — tell us about your situation in your own time.

3. Onboarding video call — a caseworker finalises your details, answers any questions and takes your first monthly payment of £110 to begin your application.

4. Mental Capacity Form (COP3) — we complete this on your behalf for you to forward to the assessor.

5. Form preparation — we prepare all remaining court forms ready for your e-signature.

6. Fee remission — if the person lacking capacity qualifies, we complete the remission form to reduce court fees.

7. Application submission — we submit the entire application to the Court of Protection on your behalf.

8. Monthly payments continue — £110 per month covers your ongoing case management, fortnightly updates and all court follow-ups.

9. Fortnightly updates — we keep you informed by email and phone every two weeks throughout.

10. Court timeline:

  • Acknowledgement: approximately 3 weeks
  • Official review: approximately 8 weeks (the overall process typically takes 6–9 months)

11. Deputyship Order received — once your order arrives, your monthly payments stop. Total cost capped at £990 regardless of how long the court takes.

Our Probate Division

Probate

While our core expertise lies in Court of Protection applications, we are also proud to offer a dedicated Probate Service Division — available to all families who need support following the death of a loved one. Whether the deceased was previously under the Court of Protection or you’ve been referred to us independently, our experienced team is here to guide you through the process with empathy, clarity, and care.

Why Choose Us for Probate?

Our probate service is supervised by a retired solicitor with decades of experience in this field, delivered by trained caseworkers who handle every estate matter with care, sensitivity and clarity. We offer fixed fees so you always know exactly what you will pay — no hidden costs, no surprises.

Our Probate Division is proudly headed up by Prime Legal Consultancy, bringing additional expertise and professional oversight to every case we handle.

Our Fixed Fees (VAT included):

Estates under £5,000: £300

£5,001 to £325,000: £750

Over £325,000: £1,100

Full estate administration (creditors, beneficiaries, asset distribution): 1.5% of the gross estate (minimum £950)

Pay monthly if you prefer — all fees can be spread across three equal monthly payments at no extra cost.

Most families ask us to handle just the initial Grant of Probate, which gives them legal authority to access and manage the estate. If you would prefer us to handle the full distribution process from start to finish, we can do that too.

We offer a free consultation so you can understand your options with no pressure or obligation.
